1. (a) All contracts of Sale between you (the "Buyer") and the Algerd USA Services, Inc (hereafter called the "Seller") incorporate these Terms and Conditions.
   
   (b) All such contracts are to be governed and construed in accordance with Nevada State Law, USA and the Buyer and the Seller submit to the jurisdiction of the Nevada courts.

PRICING

1. All prices are in (US$) and are exclusive of shipping and duty costs. The Seller reserves the right to change any advertised price before an order is placed.

DELIVERY AND CARRIAGE

1. (a) Delivery will be effected by delivery of the goods subject of the order by the Seller to the Buyer's delivery address.
   
   (b) Delivery charges are calculated on the total weight of the items in order and delivery address. The Seller will make all reasonable efforts to send the goods during the same day the order is placed. The Buyer will be advised of any delay. Packages and greeting cards are supplied free of charge and are not returnable.

PAYMENT

1. Payment can be made by Visa or MasterCard. Payment will be debited from the Buyer's account by Authorize.net before the despatch of the order. The Seller will take all care within our power to keep your order and payment details secure, but purchases from this website are at the Buyer's risk.

PASSING OF TITLE

1. Property and title in and to the Goods will not pass to the Buyer until Seller has received payment in full in cleared funds for the price of the goods and the goods have been dispatched by the seller to the buyer. The Goods will be at the Buyer's risk as from the time when Goods are delivered. Insurance on the Goods so delivered will be the responsibility of the Buyer.

AVAILABILITY

1. (a) All products are subject to availability and may be withdrawn at any time. Whilst the Seller will make every effort to have adequate stock of the items on offer, the Seller may occasionally be unable to complete the order. In this case, the Seller will advise the Buyer by e-mail, offer alternative goods or refund the Buyer's credit card accordingly.
   
   (b) In addition, supplies of goods may be discontinued without any liability on the part of the Seller in respect of breach of any obligation arising under any other unexecuted contact then existing between the Buyer and the Seller.
   
   (c) The Seller reserves the right at any time to make any changes that he considers necessary to comply with applicable statutory or regulatory requirements

EXCEPTIONS, DELAYS, ETC.

1. (a) Should the Seller be delayed in or prevented from making delivery by strikes, lockouts, trade disputes, difficulty in obtaining workmen or material, breakdown of machinery, accident, fire, force majeure, civil riot, requisitioning by government, orders or regulations of government, or any other circumstances outside the Seller's control, the Seller will be at liberty to cancel or suspend the contract without incurring liability for any loss or damage resulting to the Buyer.

CLAIMS AND RETURNS

1. (a) The Seller will incur no liability whatsoever in respect of short deliveries or non delivery of whole or part consignments or damaged or defective Goods unless:
   • A note of complaint is made by the Recipient of the Goods or the Buyer on the carrier's delivery note; and
   • In the case of all deliveries, a claim is made to the Seller within three days of receipt of the goods to the reasonable satisfaction of the Seller that the delivery was short, or that there was non-delivery of whole or part assignment, or that the goods were damaged or defective before delivery took place. All breakages, including the carton or other container and all wrapping materials etc., must be held for inspection. In the event of cartons arriving damaged, the delivery sheet should be signed as such.
   • Provided that the Buyer complies in all respect with the foregoing requirements in Conditions the Seller will issue a refund for whole or part of the short delivery, or non-delivery, or damaged or defective goods (as the case may be). In the event of a return of damaged goods the refund will include reasonable postage costs incurred in the return on proof of cost of carriage return.
   
   (b) In the event that the Buyer wishes to return Goods to the Seller which are not damaged or defective the Seller will accept such Goods if they are returned to the Seller carriage paid and in the same condition as when despatched by the Seller. The Seller will then provide a full refund of the original purchase price of the Goods. Unless there was an error on the part of the Seller in despatching an order, or the Goods were faulty, the refund will be exclusive of delivery charges. To return any products for any reason, please contact the Customer Service.
   
   (b) Subject to the extent permitted by applicable law of the country from which the Buyer is accessing this website, the Seller will in no event be liable for any losses, expenses, labour costs, or other damages whatsoever and howsoever caused, whether direct or consequential, which arise out of or otherwise in connec-tion with the Goods (including but without prejudice to the generality of the foregoing liability for personal injury or death).
   
   (b) Subject to the extent permitted by applicable law of the country from which the Buyer is accessing this website, any condition, warranty or statement in respect of the Goods, whether expressed or implied by statute, custom of the trade or otherwise (including, but without prejudice to the generality of the foregoing any such condition, warranty or statement as to the quality of the Goods or their fitness for any particular purpose) is hereby excluded unless agreed in writing with the Seller.
